Obama’s AG Holder Scuttles Prosecution of USS Cole Case – Victims Being Denied Justice

US DOJ scuttles prosecution bid of alleged USS Cole bomber

Abd al-Rahim al-Nashiri

WASHINGTON — The Obama Administration has shelved the planned prosecution of Abd al-Rahim al-Nashiri, the alleged coordinator of the October 2000 suicide attack on the USS Cole in Yemen, according to a court filing.

The decision at least temporarily scuttles what was supposed to be the signature trial of a major Al Qaeda figure under a reformed system of military commissions. And it comes practically on the eve of the 10th anniversary of the attack, which killed 17 sailors and wounded dozens when a boat packed with explosives ripped a hole in the side of the warship in the port of Aden.

In a filing this week in the US Court of Appeals for the District of Columbia, the Justice Department said that “no charges are either pending or contemplated with respect to al-Nashiri in the near future.’’

The statement, tucked into a motion to dismiss a petition by Nashiri’s attorneys, suggests that the prospect of further military trials for detainees held at Guantanamo Bay, Cuba, has all but ground to a halt, much as the administration’s plan to try the accused plotters of the Sept. 11, 2001, attacks in federal court has stalled.

Only two cases are moving forward at Guantanamo Bay, and both were sworn and referred for trial by the time Obama took office.

In January 2009, Defense Secretary Robert Gates directed the Convening Authority for Military Commissions to stop referring cases for trial, an order that 20 months later has not been rescinded.

Military officials said a team of prosecutors in the Nashiri case has been ready go to trial for some time. And several months ago, military officials seemed confident that Nashiri would be arraigned this summer.

“It’s politics at this point,’’ said one military official who spoke on the condition of anonymity to discuss policy.

He said he thinks the administration does not want to proceed against a high-value detainee without some prospect of civilian trials for other major figures at Guantanamo Bay.

A White House official disputed that.

“We are confident that the reformed military commissions are a lawful, fair, and effective prosecutorial forum and that the Department of Defense will handle the referrals in an appropriate manner consistent with the interests of justice,’’ said the official, who also spoke on the condition of anonymity.

The Defense Department issued a statement yesterday saying the case is not stalled. “Prosecutors in the Office of Military Commissions are actively investigating the case against Mr. al-Nashiri and are developing charges against him,’’ it said.

A Tree Grows at Ground Zero – First Trees Planted For Ground Zero Memorial Garden

A tree grows at Ground Zero

After nearly nine years, life is returning to Ground Zero in a tangible way.

Crews today began planting 16 swamp white oaks at the World Trade Center site. They are the first of nearly 400 trees to be planted around the eight-acre memorial to the nearly 2,800 people were killed when terrorists attacked the twin towers on Sept. 11, 2001.

The trees will dot a cobblestone plaza surrounding two huge pools built on the footprints of the destroyed towers.

Joe Daniels, president of the 9/11 Memorial Foundation, was on hand at the site to help with the planting. He said designers of the memorial envisioned a lush and quiet green space that would bring solace to visitors.

“When people come up to the pools and see the names and be under this canopy, this forest, it will be a very peaceful environment,” Daniels said.

Cultivated for four years at a nursery in Millstone, N.J., the 16 trees were loaded onto eight tractor-trailers at midnight Friday for the 35-mile trip to Manhattan. Several were planted overnight and into Saturday morning on the western side of the memorial plaza.

The memorial plaza will essentially become a rooftop garden, built atop the deep chasm left by the destroyed towers. It will cover the museum commemorating the 2001 attacks, commuter train platforms and a parking garage that are being built as far as 70 feet below ground.

The trees were irrigated and fertilized for four years at 15-acre nursery in New Jersey. Daniels said the swamp white oaks were selected for their beauty and their ability to withstand Manhattan’s cold, snowy winters and steamy summers.

The trees come from New York, Pennsylvania and Washington, D.C. — the places where the attacks hit. They were about 25 feet tall when first planted and are expected to soar to 60 to 80 feet high.

Once they are planted, an arborist will work full-time to prevent the construction site’s daily dust and clutter from damaging the oaks.

An elaborate subterranean irrigation system, with individual tubes running to each tree, will water and fertilizer the grove. The trees’ condition, soil moisture and temperature can be monitored remotely through sensors embedded into their root balls.

“Our expectations are we will have 100 percent survival of the trees,” said Tom Cox, CEO of Environmental Design, the Houston company that has cared for the trees and ferried them to the trade center site.

08/28 Update: Glenn Beck’s 8/28 Restoring Honor Rally – What it is all about …

08/28 Restoring Homor Rally

UPDATE: 08/28/2010

“A conservative blogger’s assertion that parts of the nation’s capital should be avoided as unsafe, created an uproar on the blogosphere, accusations of racism and a sharp response by angry city leaders.”

The Rest of the story:

The following from that Ultra Conservative Organization MSNBC … I’ll bet they have been secretly “Pro-Beck” after all … the racists at MSNBC …  they had us all fooled didn’t they …

“Crime Statistics in DC”

After the news today that MSNBC.com acquired EveryBlock, a service that tracks local news in 12 different cities and organizes news, reviews, and other localized data into searchable locales (zip codes, neighborhoods, etc), I decided to poke around a bit.

One of the areas that EveryBlock tracks is crime statistics and Washington, DC is one of the 12 cities.

I discovered that according to publicly available crime data, there are over double the number of crimes reported in Northwest than their are in Southeast or Northeast.

In DC, the city is divided into four quadrants based around direction from the U.S. Capitol building. That means

Rev Martin Luther King

everything south of the National Mall and west of South Capitol St is considered southwest.

South of East Capitol St and east of South Capitol St is Southeast and is generally considered the most violent area of the city. North of East Capitol St and east of North Capitol St is Northeast and is largely residential.

North of the National Mall and west of North Capitol St is Northwest, the busiest and most upscale quadrant of the city.

I dug around for a bit, looking at data by zip code, by ward, by quadrant, by types of crime, etc. Needless to say, it was quite startling to see this chart via Everyblock.com:”

BY QUADRANT (violent crimes)

Northwest      1,457      51%

Northeast       658        23%

Southeast      636        22%

Southwest       87            3%

Unknown           5             0%

Now just how many of you knew that MSNBC and MSNBC’s subsidiary “Everyblock” were so racist … Let’s close down MSNBC … The protest starts today at noon in front of the MSNBC Headquarters … Will I see you there Rev Sharpton, in front of MSNBC to protest this outrage?

The “Conservative Blogger” mentioned in the “main article” only used the statistics … now you know who created them …

Alfred Daniel Williams King (known as A.D.) was arrested with his older brother and 70 others while participating in the October, 1960 lunch counter sit-in in Atlanta. On 11 May 1963, A.D. King’s family home was bombed… After MLK’s assassination ADK assumed his post as co-pastor of Ebenezer Baptist Church.

“When I join Beck and all gathered at the Lincoln Memorial this weekend, I will talk about my Uncle Martin and the America he envisioned. I will talk about honor and character and sacrifice. I will be joined by those who represent the diversity of the human race. On Saturday, Uncle Martin’s dream of personhood and human dignity will resound across America. And the Park Police should consider themselves forewarned: As we stand in the symbolic shadow of the great American who signed the Emancipation Proclamation, we just might sing.” Dr. Alveda King

Marcus Luttrell is a former Petty Officer First Class and United States Navy SEAL, He received the Navy Cross for his actions in 2005 facing Taliban fighters during Operation Red Wings. In 2010, Luttrell established the Lone Survivor Foundation (SOWF). The foundation’s mission is to “Go to extraordinary lengths to Welcome Home, Empower and Restore American Wounded Warriors, their Families and Surviving Families” …
SOWF, which has only eight staff members, is happily inundated thanks to Glenn Beck’s promotional efforts. The group typically raises money through banquet dinners – the most one of these events has ever raised is $1 million, which caused the SOWF staff to “do a little happy dance,” according to Edie Rosenthal, a retired Navy lieutenant commander and spokeswoman for the group. Since Glenn Beck has started talking about the group on his radio and television shows in advance of the 8/28 rally, some $5 million in donations have poured in. “We’ve never had an event that cost this much either,” says Rosenthal. “I was at the Lincoln Memorial just looking at the number of port-a-potties and the screens that are being set up.” …

Alveda King

From Dr. Alveda King’s Blog

Martin Luther King, Jr.’s legacy, like the Lincoln Memorial itself, belongs to all Americans. I am participating in Glenn Beck’s Restoring Honor Rally not to advance any political agenda, but to advance the concept of honor in our nation.

The Book of Proverbs teaches that before honor comes humility. The Restoring Honor Rally has been organized for the purpose of giving honor to those who have humbled themselves to serve each and every one of us by defending our great country, for honoring our heroes, our heritage and our future. If our soldiers don’t deserve honor, I don’t know who does.

My Uncle Martin did not say that we should judge men by their support for bigger or smaller government, but rather by the content of their character. That is what I intend to address on August 28.
