Day 81 In The Gulf: Will New Cap And Ships Contain Gulf Leak by Monday?

The work to replace a leaky containment cap on the well head with a tighter one will begin Saturday, at the same time, a ship connecting to a different part of the leak is expected to come online Sunday. The combination of the cap and the new vessel could collect all the leaking oil by Monday, stopping it from escaping into the Gulf of Mexico for the first time since April 20. The new containment cap is expected to form a better seal over the well head.

On April 23, 2002, the U.S. Department of Justice, Office of Legal Counsel (OCL) issued a memorandum concerning the issue of Federal Preemption of concurrent State enforcement of criminal and civil viloations under the Immigration Laws of the United States. That memo reversed prior opinions held by the Department of Justice and specifically states: We conclude that part 1252 (C), does not preempt State arrest authority in any respect. That the “power of arrest” is not limited to “authorization delegated from the Federal Government”. The OLC stated, “we determine that our 1996 advice was mistaken and that we should have concluded that federal statutory law posed no obstacle to the authority of state (and local) police to arrest aliens on the basis of civil deportability.”

When Attorney General Ashcroft announced the NSEERS system, he also announced the unequivocal conclusion of the Department of Justices Office of Legal Counsel: “[A]rresting aliens who have violated criminal provisions of [the INA] or civil provisions that render an alien deportable . . . is within the inherent authority of the states.”. This declaration is in direct contrast to what has been alleged in the Obama Adminstration’s lawsuit filed by the Department of Justice headed by Attorney General Eric Holder.
